Special City Council Meeting
Public Hearing - Engineering:
Conduct a public hearing regarding an ordinance for the imposition of impact fees pursuant to Chapter 395 of the Texas Local Government Code.
The City Council executed Professional Services Contract 14456, with Kimley Horn and Associates, on May 14, 2019, and appointed a Capital Improvements Advisory Committee (CIAC) on June 11, 2019, to study impact fees for the City of Lubbock. The technical portion, for the land use assumptions and capital improvements plans (capacity plans) of the evaluation and study, is complete. In accordance with Texas Local Government Code Chapter 395.042, the City Council conducted a public hearing on May 28, 2020, and the public hearing was continued on June 23, 2020. The City Council adopted the land use assumptions and capital improvements plans (capacity plans) through Resolution No. 2020-R0211 on June 23, 2020. The final Impact Fee study has been completed and includes recoverable costs and details the maximum fees based on the technical findings and evaluation.
In accordance with Texas Local Government Code Chapter 395.050, the Capital Improvements Advisory Committee (CIAC) provided written comments to the City Council on September 22, 2020, at the regularly scheduled City Council Work Session.
In accordance with Texas Local Government Code Chapter 395.047, the City Council must conduct a public hearing to discuss the possible imposition of an impact fee. In accordance with Texas Local Government Code Chapter 395.051, the City Council shall approve or disapprove the imposition of impact fees within 30 days of the close of this public hearing.
