This proposal is to amend Chapter 40 of the Code of Ordinances, in order to update the provisions for alcohol sales in commercial zoning districts, to ensure the provisions match what is outlined in the Texas Alcoholic Beverage Commission (TABC) regulations. This includes allowing the on-premise sale of alcohol as an incidental use in grocery stores and drug stores and removing the prohibition of alcohol sales through a pass-out window.
Staff recommends approval of the request. The Planning and Zoning Commission heard this case on November 7, 2019, and recommended approval of the request by a unanimous vote.
