Meeting Date: 12/17/2019

Agenda Item
Ordinance 2nd Reading - Planning: Consider Ordinance No. 2019-O0176, amending Chapter 40 “Zoning” of the Code of Ordinances of the City of Lubbock, Texas, with regard to Article 40.03 “Districts” and conditional uses in multiple zoning districts and alcohol sales as a permitted use in various districts; and Article 40.02 “Administration” regarding special exceptions before the Zoning Board of Adjustment in order to bring ordinances into compliance with State Law; providing a savings clause; providing a penalty; and providing for publication.
Item Summary

On December 3, 2019, the City Council approved the first reading of the ordinance.

This proposal is to amend Chapter 40 of the Code of Ordinances, in order to update the provisions for alcohol sales in commercial zoning districts, to ensure the provisions match what is outlined in the Texas Alcoholic Beverage Commission (TABC) regulations. This includes allowing the on-premise sale of alcohol as an incidental use in grocery stores and drug stores and removing the prohibition of alcohol sales through a pass-out window.

Staff recommends approval of the request. The Planning and Zoning Commission heard this case on November 7, 2019, and recommended approval of the request by a unanimous vote.
