Ordinance 2nd Reading - Planning:
Consider Ordinance No. 2019-O0015, for Zone Case 3369, a request of Jason R. Bush, for Beck Steel, Inc., for a zoning change to Heavy Manufacturing (M-2) from Interstate Highway Industrial (IHI) on Lot 2, Block 6A, Riverlawn Addition, the east part of Lot 1A, Lot 2, Hancock Addition, and Block A, Section 15 AB 85 Tract D14, 401 North Loop 289.
On January 22, 2019, the City Council approved the first reading of the ordinance.
The applicant is seeking a zone change to M-2 zoning, as the existing steel fabrication plant on the property is legal non-conforming. The change to M-2 would make the business legal, as it is a permitted use in the M-2 district and would allow the business to expand without additional approval from the Zoning Board of Adjustment. However, if approved, any authorized use in M-2 zoning may be constructed on this site. The property currently has an existing driveway approach on North Loop 289, at the northeastern most corner of this site’s frontage.
The intent of the current IHI zoning is, “…to provide for planned, quality industrial development within the interstate corridor so that persons entering the city along the corridor have a good first impression, and to maintain a quality appearance which will stabilize or increase real property values. Special consideration shall be given building height for developments adjacent to Mackenzie State Park, the Yellowhouse Canyon Lakes, and the Central Business District.”
Traffic Network/Infrastructure Impacts:
North Loop 289 is designated as a Freeway in the City’s Master Thoroughfare Plan (MTP), which should be able to adequately handle the traffic associated with the permitted uses in the M-2 district. Additionally, North Ash Avenue, which is located just east of the site, is designated as a partially completed Collector.
Compatibility with Surrounding Property:
The proposed zoning is compatible with the surrounding area, which is primarily industrial.
Conformance with the Comprehensive Plan Principles and Future Land Use Map:
The request will encourage the expansion of an existing business in northeast Lubbock and promote stabilization of an area east of Interstate 27. The Future Land Use Map designates this area for “Industrial” land uses. The request for M-2 zoning is appropriate in this land use category.
Conformance with the Zoning Ordinance:
The purpose of the M-2 district is to “provide for those uses defined as heavy industrial and/or manufacturing use which will or may produce off-site noise, odor, or dust. The regulations are designed to provide standards for proper on-site development and to protect the environmental quality of adjacent areas and the city in general”.
The request is in conformance with the Zoning Code of Ordinances.
Suitability of the Property for Uses to be Allowed:
M-2 zoning is in conformance with the Comprehensive Plan and Future Land Use Map.
The request conforms to the Zoning Code of Ordinances.
There should not be any negative impact on the surrounding area or thoroughfare system.
Related Plans and Policies:
E-2610, approved on 12-11-18, approved the expansion of a legal non-conforming use on this property.
Planning and Zoning Commission Hearing:
No citizens spoke in favor of, or in opposition to the request. Staff did not receive any written responses.
On January 3, 2019, the PZC recommended approval of the request by a unanimous vote.
