Ordinance 1st Reading - Planning:
Consider an ordinance repealing Ordinance 2018-O0115, which extended the moratorium set forth in Ordinance 2018-O0048 on accepting, processing, or acting upon certain applications for any permits for the construction or modification of any billboard, as defined by Section 40.01.003(23).
Ordinance 2018-O0048, approved by the City Council on April 16, 2018, adopted a 180 day moratorium and prohibition on accepting, processing, or acting upon certain applications for any permits for the construction or modification of any billboard, as defined by Section 40.01.003(23).
Ordinance 2018-O0115, approved by the City Council on September 27, 2018, extended the moratorium by an additional 180 days. The moratorium is currently set to expire on April 11, 2019.
The Local Government Code provides cities the ability to adopt moratoriums on regulations, in order to allow time to create new regulations. During the moratorium, staff proposed an amendment to the current zoning regulations, which included billboards. The ordinance for this amendment was approved at first reading by the City Council on January 22, 2019 and is scheduled to have a second reading on February 12, 2019.
If approved, this ordinance will become effective on March 4, 2019. Accordingly, the moratorium on billboard permit processing will no longer be needed. Staff recommends the City Council approve this ordinance repealing the moratorium.
