Ordinance 2nd Reading - Planning: Consider Ordinance No. 2019-O0106, amending Chapter 40 “Zoning” of the Code of Ordinances to remove the separation and parking requirements related to microbreweries and similar uses from the Central Business District (CB-4) Depot District, which are outlined in Section 40.03.2121(a) and Section 40.03.2122(15).
Item Summary
On June 25, 2019, the City Council held a public hearing regarding this matter.
On July 23, 2019, the City Council approved the first reading of the ordinance.

On August 9, 2018, Ordinance No. 2018-O0091 was approved by a City Council vote of 6-1 and amended the Code to allow the following uses in certain commercial districts: Micro-brewery, Brewpub, Micro-distillery, Micro-winery, Wine Tasting Facility, Beer Tasting Facility, Alcohol Tasting Facility, Brewery, Winery, and Distillery. All of these uses except wineries, breweries, and distilleries are allowed by right within the Central Business Districts.

However, the Central Business District; Depot District (CB-4) differs from the other Central Business Districts, in that it has stricter separation and parking requirements. The following requirements only apply to the CB-4 district:

Sec. 40.03.2121     Separation

(a)     No bar, cocktail lounge, private club, nightclub[,] dance hall, brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility shall be located within six hundred feet (600') of any established bar, lounge, private club, nightclub, dance hall, brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility. This distance shall be measured in a direct line from front door to front door.

Sec. 40.03.2122     Off-street parking

(a)     Off-street parking requirements.

(15)     Any brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility shall provide one (1) parking space per one hundred seventy-five square feet (175 sq ft) of the retail, tasting, or eating area, and one (1) parking space per two thousand square feet (2,000 sq ft) of the manufacturing or storage area.

Staff is requesting that both the separation requirement and parking requirement for these uses be removed, which will allow the CB-4 district to have the same separation and parking requirements as the other Central Business Districts.
