Ordinance 2nd Reading - Planning:
Consider Ordinance No. 2019-O0105, amending Chapter 40 “Zoning” of the Code of Ordinances to correct the list of permitted uses in the Commercial (C-4), Light Manufacturing (M-1), and Specific Use districts.
On July 23, 2019, the City Council approved the first reading of the ordinance.
In August 2018, Ordinance No. 2018-O0091 was approved by the City Council and amended the Code to allow the following uses in the C-4 district: Brewpub, Micro-brewery, Micro-distillery, or Micro-winery, Wine, Beer, or Alcohol Tasting Facility. In addition to those uses, it also allowed the following uses in the M-1 district: Brewery and Distillery.
In December 2018, Ordinance No. 2018-O0134 was approved by the City Council and amended the Code to allow self-storage facilities as a Specific Use in the C-2 and C-3 districts, in addition to the C-4 district. It also updated the minimum conditions required in order to construct a self-storage facility in these districts, including landscaping, screening, and building materials.
In February 2019, Ordinance No. 2019-O0016 was approved by the City Council and amended the uses in the C-4 district based on the attached chart. This ordinance was drafted based on the Code language that was in place prior to the amendments adopted in August and December 2018, so it did not include the uses and requirements those ordinances had adopted. Therefore, when this ordinance was codified, it inadvertently removed the uses and requirements listed above from the C-4, M-1, and Specific Use districts.
The proposed ordinance will correct the error and add the uses and requirements previously approved back into their respective districts.
