Ordinance 1st Reading - Planning:
Consider an ordinance amending Chapter 38 “Subdivisions,” Articles 38.03 and 38.04 "Preliminary Plats and Final Plats" of the Code of Ordinances in order to define when a plat is deemed as filed.
During the recent Texas 86th Legislative session, House Bill 3167 was enacted, which requires the municipal authority responsible for approving plats to approve, approve with conditions, or disapprove a plat or plan within 30 days after the date it is filed.
In order to address this requirement, staff is proposing to amend the subdivision regulations to incorporate a clear definition for the term "filed." The proposed ordinance defines that a plat shall be deemed "filed" when the planning department completes its review process and the plat is placed on the Planning and Zoning Commission (PZC) agenda.
This will ensure that only plats which have been reviewed by staff and deemed complete, are forwarded to the PZC for consideration.
